These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and MYAL ("Platform", "we", "us", or "our"). By accessing, registering for, browsing, or utilizing any features of MYAL, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you must immediately cease accessing and using the Platform.

2. Eligibility & Account Registration

To register an account or create a profile on MYAL, you must be at least 18 years of age or the age of legal majority in your jurisdiction. By registering, you agree to:

• Provide accurate, current, and complete registration information during signup and keep your profile details updated.
• Maintain the confidentiality and security of your account login credentials, passwords, and sessions.
• Accept full responsibility for all activities, profile updates, and communications occurring under your account.

• Refrain from registering automated bot accounts or accessing the platform via unauthorized automated means.

3. User Handles, Custom URLs & Brand Protection

MYAL grants registered users the ability to claim an exclusive public handle (such as myal.link/yourname). The following conditions strictly apply to handle reservation:

• No Handle Squatting: Registering handles solely for domain speculation, holding them inactive to resell for profit, or preventing others from using them is strictly prohibited.
• Trademark & Identity Protection: You may not register a handle that infringes on any registered trademark, trade name, copyright, or impersonates an individual, company, or governmental entity without express legal authorization.
• Right of Reclamation: MYAL reserves the absolute right to revoke, reclaim, reassign, or rename any handle that violates intellectual property rights, impersonates an organization, or remains dormant and unpublished for an extended period.

4. Merchant of Record, Subscriptions & Paddle Billing

We partner with industry-leading payment infrastructure to provide seamless, compliant global checkout:

• Merchant of Record: Our order process, currency conversion, tax calculation, invoicing, and recurring subscription billing are conducted by our authorized online reseller and Merchant of Record, Paddle.com Market Ltd ("Paddle"), located at Judd House, 18-29 Mora Street, London EC1V 8BT, United Kingdom.
• Paddle Buyer Terms: When purchasing a subscription (such as MYAL Pro or Business), you enter into a commercial transaction governed by Paddle's Checkout Buyer Terms and conditions.
• Taxes: Paddle automatically calculates, collects, and remits applicable VAT, GST, and state sales taxes based on your billing address and country of residence.
• Automatic Renewal: Paid subscriptions automatically renew at the conclusion of each billing period (monthly or annual) at the then-current price, unless you cancel your plan prior to the renewal date via your Account Dashboard.
• Price Adjustments: We reserve the right to revise subscription fees upon reasonable advance notice. Any price adjustments will take effect at the start of your subsequent billing period.

5. 14-Day Money-Back Guarantee & Cancellation

6. User Content & License Grant

You retain full ownership and intellectual property rights to all profile headlines, bios, links, images, banners, and media that you publish on your public MYAL profile ("User Content"):

• License to MYAL: You grant MYAL a worldwide, non-exclusive, royalty-free, transferable license to host, store, cache, display, replicate, and format your User Content solely to the extent necessary to deliver, operate, optimize, and promote the Platform.
• Representations & Warranties: You represent and warrant that you own or possess all necessary rights, licenses, and permissions to publish all User Content and destination URLs appearing on your profile, and that such content does not violate any third-party rights or applicable laws.

7. Acceptable Use Policy

You agree to use MYAL in full compliance with all local, national, and international laws. You explicitly agree NOT to upload, link to, or distribute:

• Illegal or Deceptive Material: Fraudulent schemes, phishing portals, deceptive landing pages, illegal narcotics, counterfeit goods, or unauthorized financial investment schemes.
• Harmful or Malicious Code: Malware, viruses, trojans, link-redirect cloaking, or exploit kits that damage visitors' devices or compromise security.
• Harassment & Hate Speech: Defamatory, abusive, threatening, racially derogatory, or hateful content targeting individuals or groups.
• Sexually Explicit Content: Pornography, adult services, non-consensual sexual imagery, or exploitation of any kind.
• Platform Abuse: Attempting to probe, scan, or breach platform security, reverse engineering source code, launching denial-of-service (DoS) attacks, or bypassing subscription plan limits.

Any account found in violation of our Acceptable Use Policy will face immediate suspension or permanent termination without notice.

8. Analytics, Tracking Pixels & Privacy Compliance

MYAL equips users with privacy-focused built-in traffic analytics (profile views, link clicks, geographic locations, and referrers):

• Built-in Analytics: Our native platform analytics do not track or sell visitor personal data and do not require intrusive cookie prompts.
• User-Added Pixels: Pro and Business users who integrate external tracking scripts (e.g., Meta Pixel, Google Analytics, TikTok Pixel) are solely responsible for ensuring that their public profiles comply with all applicable privacy regulations (such as GDPR, ePrivacy Directive, CCPA/CPRA). If required by applicable laws, you are responsible for maintaining any necessary cookie consents and visitor disclosures.

9. Intellectual Property of MYAL

All software, proprietary algorithms, visual designs, UI layouts, brand logos, icons, documentation, and design systems comprising MYAL are the exclusive property of MYAL and its licensors. You agree not to copy, duplicate, reproduce, reverse engineer, sell, or exploit any portion of the Platform without our express prior written permission.

10. DMCA & Copyright Infringement

We respect the intellectual property rights of creators and expect our users to do the same. If you believe your copyrighted work has been improperly published or linked from a MYAL profile, please deliver a formal DMCA Notice to our designated agent at [email protected] including:

• Identification of the copyrighted work claimed to be infringed.
• Identification of the infringing URL or material on MYAL.
• Your legal contact information (full name, address, telephone number, and email).
• A statement of good faith belief that the disputed use is not authorized by the copyright owner.
• A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

11. Disclaimer of Warranties

The Platform, services, and all associated content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. MYAL disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MYAL, its founders, directors, employees, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, revenue, data, goodwill, or business interruption), arising out of or in connection with your access to or inability to use the Platform.

Our aggregate liability for all claims arising out of or related to these Terms or the Platform shall not exceed the greater of: (a) the total amount paid by you to MYAL during the twelve (12) months immediately preceding the event giving rise to liability, or (b) fifty United States Dollars ($50.00 USD).

13. Indemnification

You agree to defend, indemnify, and hold harmless MYAL, its directors, officers, employees, and agents against any claims, actions, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Platform, (b) your User Content and destination links, or (c) your violation of these Terms or applicable law.

14. Termination & Account Deletion

You may terminate your account at any time via your Account Settings ("Delete Account"). MYAL reserves the right, in its sole discretion and without liability, to suspend, disable, or permanently delete your account, with or without prior notice, if we believe you have violated these Terms, engaged in fraudulent activities, or created potential legal liability for the Platform.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable to internet SaaS services. In the event of any controversy or dispute, the parties agree to first attempt in good faith to resolve the matter through informal dispute negotiation by contacting [email protected] prior to initiating formal arbitration or court proceedings.
